I would like to see the 3-day rule be changed to 6-day rule. If I hire someone on Tuesday, then I am out the rest of the week, I've missed the 3-day window; if I'm schudule to be on vacation for a week; there is no one else, in our company, that could do this. Most people take a week vacation. I would think most companies have only one (1) PR/HR person. I'm strongly asking that this be changed.
DHS and SSA should ask employers to post a sign in theirs office that states that the names on their SS card should be the same as the names they put on the form I-9. When jobs hunters fill out their form I-9 for employment, this would save time for both parties and avoid letters bean sent to either parties about mismatch names.
Why is it that when the employee submits their email address, the employer is no longer sent TNC notifications? The employer has always received notifications, and should, being that they are responsible for E-Verify compliance and the compliance of their workforce. After all, this is their employee.
When in the "Enter Form I-9 Information" section of the E-Verify process, it would be SO HELPFUL if the Date of Birth, Document Expiration Date and the Hire Date were in mm/dd/yyyy format, as it is on the I9 form. It is easier than converting the numbers from the I9 for the month, to the actual word for that month. Seems simple, but it would be amazing if you could change that!
Remove Section 3 and require a new I-9 to be completed for all new hires, rehired, and reverifications. In addition, require an E-Verify case to be created for each I-9. This would standardize the process and improve compliance rates. However, it may require legislation to implement.
Do not require the user to 'lie' by indicating that the photos match when E-Verify does not return a photo for a document subject to photo matching. If there is no photo available from E-Verify to match to the employee's document, then the photo matching step should be skipped. This should be the case using the E-Verify website as well as Web Services.
Paragrah A.6.a. of the MOU provides that if the employee presents a List B document, that employers may only accept List B documents that contain a photo. DHS and E-Verify have made changes to the TNC emails. This is good for employers and employee. When verifying employment status there is now a given time to respond to the TNC when the records do not match there data base or if your SSN is not updated and needs to be done eg a different name.
Since 2005 employer agents with an electronic I-9 product have been allowed to use electronic signatures on TNC documents. Having E-Verify provide the TNC document PDFs without electronic signatures is a problem since the employer agents software will now need to figure out how to apply the electronic signatures. On E-Verify website when verifying a new hire, the online form should reflect/mimic the I-9 form. Ex: The website should request the Date of Birth in a number format just as the actual I-9 does. The Document Expiration Date (online) format should also be completed numerically, just as the actual I-9 form requests. On the My E-Verify Site - when you "Create Account" -after you do the self-check and receive "Work Authorized" status you should be given a message that says you are not eligible for My E-Verify or SSN Self Lock in your state at this time. Instead the site sends you back to "Create Account".
Only 5 states are currently eligible for SSN Lock. This should be prioritized for all states.
There is no information in the M-274 Handbook or on the I-9 Central website about recording the document number of an I-551 on Form I-9 or any guidance that an employer using E-Verify must copy both sides of a Photo Match document. To ensure that an applicant has been e-verified, a unique identification code/number should appear on I-9 PLUS on 1099 and ON TAX RETURNS. This will ensure that all employees are forced to use this system. It should be required even for existing employees to prevent someone slipping through the cracks.
This one may be controversial, but give it a chance: Why do we still have I-9 forms at all? Many ideas on this site regard ease of transferring data from the I9 into E-Verify.
